While on vacation in mid-late November I was pulled over going 90 on the freeway (traffic was flowing at 80-85 but no excuse I’m guilty of speeding), anyways, apparently my license was under suspension for failure to pay a fine. I didn’t know it was suspended as I never received any paper work saying so, thus ignorance is my only defense. this is the second time in the past 5 years this has happened, suspended same reason 3 or so years ago (Tx surcharge fine) but I thought it was all cleared up with all my old tickets from my teenage years as I was able to re-issue my license back then.

what I’m really worried about is, because I’m a "repeat offender" I’m going to get a harsher punishment, like jail time, despite them not booking me at the time of the offense. I’m supposed to be going in to schedule a payment plan but they said I must appear in front of a judge to schedule the payment plan. Since the summons is for "Payment Plan Hearing", can I still be booked for the offense?
at the bottom of the summons it states "Failure to appear for trial may result in a warrant being issued" but then it says, "you may call prior to Jan 12 and pay your fine of $XXX" where XXX = my ticket fines.

I’m a little bit more relieved to read that, but still hesitant to go….its ~200 miles away for court. and yes, I have a ride taking me

i see ticketing as a way of generating revenue for the state. in 11 years of driving i have never had an accident and 0 dollars of revenue for the state could be thousands of dollars of extra insurance for me. I am going to fight this ticket so no stupid advice like, "just pay the ticket and stop being a baby."

After spending countless minutes waiting at red traffic lights behind some yahoo who is too busy talking on their cell phone to notice that the light has changed, I’m fed up with traffic lights. So I have come up with a new plan for avoiding red lights all together: I will simply start travelling much faster. I figure, if I travel fast enough, all red lights will be Doppler shifted to green, and I will legally never have to stop again! The idea is flawless! How fast would I have to go for this to occur? And if I achieved this speed, do you think my airbag would protect my in the unfortunate case that I ran into someone who was not following such a flawless idea?

i am guilty for sure. let me remind you that the gov’t wants you to give up. look at oj simpson. he got away with murder. all i need is to put up a fight.

I got pulled over today for going 73 mph in a 55mph but i had just passed someone and had not yet slowed down. Well a FDOT(Florida Department of Transportation) decided to pull me over and give me a 0 ticket! This was my first defense, i’m sixteen. Most of my friends speed regularly and if they get pulled over (by a regular police officer) they always got a warning..no matter how fast they were going. This was my first time speeding and i’m so upset. Can the fdot pull you over? I thought they could only pull over semis..

I just got a ticket for doing 95 in a 65. I do have a history of speeding, but my last ticket was two years ago. I know I will probably see in insurance increase, but I absolutely cannot lose my license. I have to drive to graduate school 40 mins and I take care of my grandma. Will voluntarily taking an 8 hr defense driving class before judgment is passed go a long way in at least being about to keep my license? I can get documentation that I attended and submit it to my attorney for the court date. I am truly remorseful for what I have done and I consider it a lesson learned. I feel bad about it, but I just cannot lose my license.

Hi, I just received a speeding ticket, and is thinking about fighting it. I want to start the trial, and I remember telling the officer that I was only going 75 mph instead of 80 something. When the trial starts and he prepares his defense, can he use the voice recordings against me? Please help!

Here is my situation I am in. I just transferred this past semester to UMass Amherst, which is over an hour away, and I commute 5 days a week. In my first week, I got a speeding ticket, which is my first one and is also the first time I have ever been pulled over, ever. I was apparently going 80 is a 65. Everyone told me I should fight it as it may be dismissed and therefore my driving record will continue to be clean. I have court next Monday morning and this is my first time having to go to court to fight a speeding ticket. I was wondering what I should use for my defense, and what the best way to get out of it is. I realize that I was in fact speeding and shouldn’t have, and I have actually stopped speeding since then. I just feel that a warning from the officer would have been more than enough to get me to stop speeding. I have friends who have been pulled over multiple times for speeding and only get a warning, and of course I get a 0 ticket for speeding, which I rarely did before, so I can make it to school on time. Please help!!

Are there any after-market black boxes that consumers can buy and install to show proof in traffic court that you weren’t speeding? Traditional black boxes that only record 5 seconds before and 5 seconds after an accident wouldn’t suffice; these black boxes would need to record your speed and GPS location at all times. Anything out there like that?

well i got my cdl the other day my BP license the P stand for passenger endorsment cuz i want to drive the buses in new york city but when i had my regular license i got 6 points on it but neva took a defence driving course n now the buses company is say in i cant have more then 4 points on it but i want to the take the defense driving course so i will b down to 2 points n i really need the job any1 think i will get it still cuz they want to see my driving record a print out from the dmv 1 of the tickets i was speeding upstate new york the other 1 is a moving violation i was in the wrong lane

i got a photo traffic ticket for going over the speed limit in a school zone.
would it be a good defense if i said that i was going down a big hill and i was trying to slow down when the camera took my picture.

its the truth. i drive down this hill all the time.
and do photo enforcement tickets affect my insurance premium?

I got a speeding ticket going 73 in a 60 this morning on my way to work on the freeway. In my defense, I truly thought it was a 70 mph speed zone during the day, and 60 at night. But it was daytime. What should I do? I heard that I can take a driving class to get the charges dropped, and I am interested in doing that. Still, how should I plead?

2010 Was Not A Good Year To Be President

Welcome to Toastmasters, June 13, 2033. That’s right: 2033.

Today Rick Campbell, one of our senior members at age 87, is here to reminisce a bit and give us a history lesson. He says he is so old that he learned to drive an internal combustion engine car (remember those) with a manual transmission. He once owned a typewriter. He remembers when bicycles had one speed, phones had two-party lines, and cameras had something called film. As incredible as this may seem, he says that when he was young, it was common for people to smoke in restaurants and public places. He is from a different time; almost a different world.

I’m sure all of us are far too familiar with the tragic events of 2010, so Rick is not going to plow that fertile field again. Instead, he is going to give us a personal look back at the conditions which led up to that fateful year, in a speech titled "2010 Was Not A Good Year To Be President."

Yes, 2010 was long ago and far away.

As we look back on history, it appears that some Presidents had an easy ride- times of growth and stability. Teddy Roosevelt, Warren G. Harding, Dwight Eisenhower, Bill Clinton come to mind. Those were good years to be President.

Others were elected just when the Republic was facing terrible crises:

Abraham Lincoln, Woodrow Wilson, Franklin Roosevelt, George W. Bush. They rose to the occasion, even though they were controversial and widely hated while in office. Not such good years to be President.

Just a few years prior, in 2008, the country began foundering. We were in the sixth year of the Iraqi Occupation, and the economy was flat. The mainstream press clearly wanted a Democrat elected.

Although we didn’t know it until some years later, oil producing nations had colluded to secretly buy their own oil on the open market, driving oil prices to shocking levels above the true demand price- reaching a high of 2 a barrel in October, 2008, just before the general elections.

Their purpose was simple: to effect regime change in the United States.

And of course, the U.S. economy was already in a real estate slump and also suffering the curse of stagflation; slow growth and high inflation.

There were a million home foreclosures.

Independent truckers went under by the thousands.

Airlines failed. Airlines with names now long-forgotten: United, Delta, Northwestern, American. All now merged, of course, into the one lone U.S. carrier we love so much: Southwest.

Against this backdrop of weariness of the war on terror, and economic distress, the American people were ripe for a demagogue, and they certainly got one in Barack Hussein Obama.

He and his running mate Kathlene Sibelius inspired them with vague notions of hope and change; of a world in which diplomacy settled all international problems, of free universal health care, of abundant alternative energy, of peace and love.

It was a vision too good to resist.

The Republican nominee, a name you probably haven’t heard in years anyone?

Yes, it was John McCain, an obscure Senator from Arizona had no clue how to run a national campaign, and a platform nearly as liberal as Obama’s.

The selection of Condoleeza Rice as his running mate looked brilliant at first. Unfortunately, black voters viewed her as white, and women voters viewed her as one of the guys.

Even so, the McCain/Rice ticket would have won the election if it weren’t for the fact that 16 percent of conservative Republicans voted for anyone remember? That’s right, Bob Barr, another name that’s a footnote in history.

After Obama’s narrow win, thanks to recounts in Broward County, Florida, the country was positively giddy. A Democrat House, Senate, and President. At last an end to gridlock in Washington.

Camelot!

When Congress convened in January, 2009, the 44th President of the United States did something unique in history: he made good on his campaign promises.

Certainly most Americans never really thought he was serious during the campaign. But whether because of inexperience, idealism, or simply incompetence, he followed through.

In Obama’s first One Hundred Days, the Congress passed his initiatives, and he signed them into law as he said he would.

He repealed the Bush tax cuts, and increased capital gains taxes.

He enacted a windfall profits tax, and instituted price controls on
gasoline and diesel fuel.

He passed universal health care, which added an additional 10 percent tax increase on all working Americans.

He signed the Immigrant Amnesty bill which created 12 million new citizens instantly, each with entitlements.

He closed the detention facility at Guantanamo Bay, and summarily released all the detainees.

He repealed the Patriot Act, and cut funding for espionage, and eliminated all terrorist listening and wiretaps.

Most important, he began the complete and immediate withdrawal of all American troops from Iraq.

He ignored the advice of the Joint Chiefs of Staff, who wanted to retain bases in Kuwait and Qatar. Instead, he went with the recommendation of Secretary of Defense Dennis Kucinich, and ordered all troops back to U.S. soil.

Viola! In One Hundred Days, by May of 2009, it was all done, and the vision was complete. He did exactly what he said he would do.

And so it was in the summer of 2009 that things began to unravel for Obama.

Of course, the economy needed a tax cut, not an increase, and unemployment quickly rose to 12 percent. Even attorneys and economists were put in the bread lines. Hard times!

Price con! trols on gasoline immediately led to shortages and gas lines.

The global cooling trend we have seen for the past 25 years first became obvious in 2009, exposing the CO2 global warming fraud.

People were justifiably angry.

Federal deficits increased massively because thousands of baby boomers, facing job loss and much higher taxes, simply gave up and took social security.

Although the superb U.S. health care system was thrown into disarray, the bright spot was the creation of the Federal Department of Health care, and the immediate hiring of 250,000 administrators, inspectors and auditors, the only job growth in any economic sector in 2009.

By February 2010, the U.S. military withdrawal from Iraq was complete. It was a very expensive undertaking.

And then in March, the gradual Shiite insurgencies from Iran turned into a true Iraqi civil war. In May, Iranian tanks crossed the border and quickly took Baghdad. Although the exact number is not know, at least 230,000 Sunni Iraqis died as we stood by.

Iran also quickly moved into undefended Kuwait.

President Obama did exactly what he said he would. He sent Secretary of State, Maria Cantwell, to Tehran to meet with Iranian President Ahmadinejad.

After two weeks of high level talks, the United States agreed to allow Iran to retain Iraq and Kuwait to create stability in the middle east, with the understanding that Israel would not be disturbed.

Cantwell returned to Washington, and explained the agreement in her famous speech, in which she proudly noted that the Obama administration had finally achieved "peace in our time" in the Middle East.

So there was some surprise at the rocket attacks on Tel Aviv on August 14th.

President Obama said, "This is not the Mahmoud Ahmadinejad I knew."

The Obama administration decided it would be de-stabilizing to take sides in the conflict, and approximately 29,000 Israeli civilians died during the summer and fall.

American Jews were appalled at the inaction. Yes, in 2010 most American Jews were Democrats, but because of 2010, they are solid Republicans today.

As awkward as it was, everything might have turned out all right for the Obama administration going into the fall mid-term elections of 2010, if it hadn’t been for the dirty bomb in the Port of Long Beach.

The administration had cut funding for the inspection of containers,
because they felt it showed a "lack of trust" in the international trading community.

It wasn’t really a very big bomb, and thank goodness, not a real nuclear device, but nonetheless it contaminated some expensive real estate-Newport Beach, Palos Verdes Estates- and ultimately caused the death of 14,000 Americans. People were especially annoyed that Disneyland had to be closed for decontamination.

And so, in the midterm elections, Republicans regained control of both the House and Senate, and the rest is history.

The impeachment proceedings against President Obama for "failure to protect and defend" were swift and nearly unanimous. Vice President&nbs! p;Sibeli us resigned. Newly-elected Speaker of the House, J.C. Watts, became the 45th President of the United States.

But you know the rest of the story well.

Republicans finished the war on Islamic fundamentalists, largely by aiming ICBM’s at Mecca and Medina.

No Democrat has been elected President since.

Republicans have held both Houses of Congress.

History of Western Civilization and Economics are now taught in all public schools, and in English only.

Marriage is defined as one man and one woman.

And there are border fences, north and south.

We old codgers remember the ancient Confucian curse: "May you live in interesting times."

Well, 2010 was an interesting year, but it was not a good year to be president."

(Far fetched? We are likely to find out if we continue to be unaware of the issues and vote with our emotions rather than be studious in our approach to electing our "public officials".)

Daughter hydroplaned and went in ditch. No accident. My husband went and got her told law enforcement not needed. They assisted us to get car out of ditch that night. Sat behind us with lights on. Next day officer comes to house first says she is going to ticket her for leaving the scene. I informed her that my husband called and told not needed. So then she said she would not give the failure to maintain if we had not left. Did not ask for drivers license. Record rain. Latest harvest in 40 years. I have the weather report that stated rain Heavy during that time frame My daughter was not speeding and had slowed to way below what speed limit was.
Any suggestions on a defense for this traffic ticket.

I got a speeding ticket a couple of weeks ago, but I don’t think I was going that quickly. I initially began preparing a defense for the judge since I plan to fight this in court. However, I realized I can’t go on the day my court date is assigned.

I called the courthouse and they said I just need to come in sometime the week of my court date. I’m thinking it’s most likely the cop who gave me the ticket won’t be there. Should I still prepare a defense for the judge or will he/she most likely just throw the whole thing out?
BTW, I’ve never gotten a speeding ticket before and have a perfect driving record. So I wonder if the judge will take that into account.

I need help from the legal eagles. I feel out of my league with a D. A. who is trying to be very intimidating. Here’s the situation. I live in California. My husband and I were both given rather bogus tickets on a cross country trip. He was given a ticket going I was given one coming back in the same little speed-trap town in Nevada. We are fighting both of these, and it has been a learning experience and a battle going up hill, every step of the way. I have researched my rights as best I can and found that I could request a discovery. I faxed a discovery subpoena through the clerks office. I listed the items to prepare for my defense. The clerk recommended that I talk to the D.A–she said he might be willing to throw out the case. I spoke with him this morning and he was rather intimidating and says he is going to make a motion to strike my request–he used the word "esculpatory" also. I think he is aware that my legal background is limited and it seemed that he is trying to intimidate me with my lack of knowledge. I’m aware that I could appear at the trial and make a motion to dismiss the charges because they didn’t give me what I need and that I could file for a motion for continuance. But this would mean another trip to Nevada for another trial I think–both inconvenient and frustrating–something I really don’t want to do, but will, I guess, for the sake of the justice (or lack thereof) involved in this whole sitation. And if the judge is all in cahoots with these people, are we going to get anywhere, anyway?

I’d appreciate advice about how to handle this D.A., and any recommendations about how best to prepare myself. Thank you in advance.
My request for discovery includes:

The officer’s training records pertaining to his use of the radar gun he used.
The officer’s daily log for the date of the citation.
The officer’s radar log for the date of the citation.
The officer’s arrest record for 3 months prior.
The name, model, serial number of the radar gun used and the numbers of the tuning forks used to test it.
Copies of maintenance and certification records of the radar gun.
A copy of the manual and specs of the radar gun.
A copy of the log of calibrations of the radar gun.
A copy of the repair calibration and accuracy of the tuning forks used.
A speedometer calibration certificate.
A copy of the FCC license that authorized the issuing police agency and operator of the radar gun.
A copy of both sides of the officer’s citation.
I realize the discovery is rather long, but I am utilizing advice I found from an attorney who recommended this particular list for my type of citation.

I WAS TRAVELLING SOUTHBOUND ON I35. BETWEEN AUSTIN AND SAN MARCOS, THE WEATHER WAS CLEAR/CLOUDY, WITH MODERATE TRAFFIC. I WAS STOPPED FOR AN ALLEGED SPEED OF 85 IN A 70 AT MARKER 212. ON MY TICKET IT SHOWS THE RADAR CALIBRATION AS OF 08:35, BUT AT THE TOP, IT SHOWS THAT THE TICKET WAS ISSUED AT 08:30.NOW I KNOW THEY GENERALLY RECALIBRATE AFTER EACH USE, BUT SHOULDN’T IT BE THE LAST TIME PRIOR TO MY TICKET? WHICH I WONDER IF THAT MEANS THAT HE HADN’T CALIBRATED IT BEFORE HE CAUGHT ME? WHEN I CAME OVER THE HILL, AND AROUND THE CAR NEXT TO ME AND SAW HIM, I IMMEDIATLY TOOK MY FOOT OFF THE GAS AND LOOKED DOWN. I WAS DOING MAYBE 79-80 NOT 85. I BRAKED AND SAW HIM COME AFTER ME. I WORK WITH TOOLS THAT NEED CALIBRATION, AND IF WE DON’T DO IT, THERE IS A MARGIN OF ERROR. SO I BELIEVE THE RADAR WAS MALFUNCTIONING. IS IT WORTH FIGHTING? AND IF I FIGHT DO I FORFEIT MY RIGHT TO THE DEFENSE DRIVNG OUT?

I was pulled over on I-65 in Indiana for speeding. One cop pulled me over but was not the one who had the radar on me. A second cop who was 5 miles back was the one who radared me. I had my cruise control set at 85 mph, yet the cop gave me a real hard time, began asking me numerous unnecessary questions and when his partner arrived, issued me a ticket claiming I was going 124 mph. This is absolutely ridiculous, my cruise control was set and there is no way I could have been going that fast. I drive a 2004 Ford Taurus V6 3.0L, my speedometer stops at 120 mph and even further, the car has a powertrain modulator that is factory installed that shuts the fuel pump and powertrain off after you reach 110 mph (Also have proof of this). Somehow, i was not arrested, my license was given back to me!? and i was issued a "speeding" citation with a requirement to appear in court. The cop mentioned something about the possibility of it being bumped up to reckless driving, but I am absolutely stunned by this because it is ludacris. I’m highly considering getting a lawyer, but what defense do I have in this situation. I know for a 100% fact that this ticket issued is incorrect, but how do I prove it?

Should I go with the "I was distracted" defense

Should I go with the "I wasn’t going the speed you said and you never even asked me where I was going or how fast I was going" defense

Some extra details as to why I am fighting my ticket…I was visiting Wisconsin and got a speeding ticket I was told I had to pay the fine on the spot or go to jail.

I proceeded to ask the officer my options and he said:
a) cash
b) check
c) credit
d) go to jail

I gave him my American Express card to pay it and he said "sorry we can’t take that" and I go WTF is flawed with this law!?!?!?

I was short in cash so he let me give that to him if I went and got and met up with him later.

This law defies due process in that I am required to pay the fine as if I were guilty then gives me the option to appeal the law. I am going raise hell in Wisconsin for this law because I feel it is unjust and wrong. I should have the right to pay the fine when I damn well please.

ok so im really worried im gonna get my license suspended. but here are the details. when i was 17 i was caught speeding, points were not taking off then considering i was extremely calm, did not argue, and it was first time being stopped, and the speed was even decreased. All i had to do was pay the fine. Well i turned 18 back in may and received my class D license (even if i had points taken off, the ticket should not count against me this next time right?). well bout a month ago i was pulled over for going 98 in a 55… yeah i know i was completely in the wrong, but in my defense i had just got that car and was not used to it, was upset about a fight with grandma, and late for first class of the year..i was completely zoned out and did not notice till it was too late. I pulled over way before the trooper had time to even slow down and turn around, i knew i was done for. This technically was my first bad speeding case, i think it only counts 6 pts against my license. i called a while back to pay my fine and the lady said i had to go to court..? and it was a really good chance id get my license suspended. i cant have em suspended, i need a way back and forth to school. if its my first true offense do you think i have a better chance of keeping them???.. i know i should ask my dmv or even a cop.. but i haven’t really had a chance. i just need some feedback.. i dunno. im just really worried. i can pay the fine, ive been saving money. i just need some feedback on my chances of keeping my license..
The Truth- look i know what i did was wrong, im not evil or anything geez. and i wasnt planning on throwing those excuses at a judge i know it would just make it sound like i did what i did on purpose. Im not looking for a easy way out or anything, i know i have to deal with consequences. you dont have to be such an ass. all i did was ask for how things might go down, not to be scolded like a 4 yr old. thx for your post, but no thx.

I was going through an intersection STRIGHT on GREEN on oppisite side they also had green the far left lane is used for making left turns a big sign is above light that says yeild on green there were 4 teenagers in that car I was halfway through intersection when they turned nothing I could do then the accident accurred I busted my head open needed stitches on forehead so whitch means a scar for life I was rushed 2 hosp n no one question me bout accident I also have a fractured hand n therapy 3-4 times a week 4 my head hand n neck after eveything I found info out the kids lied about who was driving n there trying 2 say it is my fault there defense is they did yeild I was speeding there were no skid marks at scene no tickets were isued I know there kids and kids get B they thought they could beat me either way its messed up in your oppinion do I have a case is it my fault or there’s please help
Yes I do have police report n it says they faild to yeild I was trapped in car so there was a couple that was at scene b4 we came 2 a stop so they didn’t see the actual accident but were there b4 anyone got out of cars they saw the boy get out of car
