Should I fight my speeding ticket for 60 in a 50…?

On my way to work I got pulled over. I was wondering if I have a good chance in fighting the ticket because of several reasons. The cop passed me going the opposite direction, there was a car in front of him and one behind him as well. The road I was on has a 50mph posted speed limit that leads into a 30mph curve. The cop and I passed one another as he can around the curse and i approached it. I saw him in my side view mirror slow down, pull off the road and flip around. At this point I knew he was coming for me. When he pulled me over he asked if I knew how fast I was going I said no. He said I was doing 72mph which I know I wasn't going that fast since from the previous stop sign to the curve is just over one mile. When he came back with the ticket he said he was going to cite me for doing 60 in a 50. To me this made me think he really wasn't for sure how fast I really was going.
In AZ you cant even get a photo radar ticket until you do 11mph or more over. Also I live in a rural area and wondering is reasonable and prudent speed would be a good defense??
Do you think I have a good chance?
They are not absolute. There is a difference between absolute speed limits and prima facie speed limits. Arizona has prima facie speed laws ... so while you're technically correct that a driver should not exceed the maximum limit, the prima facie laws are based on reasonable & prudent driving. As an example, if you are pulled over & cited for driving 70 MPH in a 65 MPH zone, you can appeal the ticket if it can be proven that you were reasonable & prudent. However, this is why most police officers will not issue citations unless the driver exceeded the limit by more than 10 MPH.

Should Arnold be cited for a ticket?

If you haven't heard about it yet, our "beloved" California governor was recently in a motorcycle accident and was riding unlicensed. He was not cited since the officers did not see him riding the motorcycle. Is this technically within State law? The bike didn't move and crash all by itself? How dumb can these officers be? This makes me upset because when I was in an accident 4 years ago, I also recieved a speeding ticket even though the officers did not witness my vehicle speeding nor the accident. They had no witness testimonial either. The car had light front end damage but a light post was knocked down so I guess thats why they thought I was speeding. I payed for it and I believe he is no different than any other citizen! What do you think? Heres one news article (obviously written in his defense,-bribed journalism at its finest)

should I pay my traffic ticket or fight it in court?

I got a speeding ticket more than 3 years ago (maybe 5). I never kept a record of it. I went to pay off the speeding ticket. I went to court and they gave me traffic school. I did not have a lawyer or public defender. That was my first time for a ticket. I got pulled over again on 9/27/08 around 1:00am for supposedly running a stop sign. My defense is I thought i had stopped, because it was an intersection and there were trees in the way. There was also no white line in the road at the end of the yellow marking. Supposedly they chopped off some of the tree limbs the next day. The officer told me there was some issues about speeding in the neighborhood and people not stopping at the stop sign. Ok late a night, come on, not many cars are around and people are usually a sleep. He told me he to me was enforcing the stop sign and had had gotten 5 people already. However, I am not sure if that was all for "running the stop" sign or if it was just for speeding. I also don't know when his shift started. Actually I think it happened around 1:00am on 9/28. All I know is that I wanted to deliver some slices of cake. I would have probably gotten in trouble if I tried to offer the officer any cake, or he would have taken it, but wouldn't change my ticket because of it.

Also, what if he was getting me for speeding, I had actually stopped at the stop sign" but he says I didn't just because he knows that not stopping at a stop sign is a 3 point infraction instead of a two point infraction. Is it normal for a cop to get 5 people for not stopping at a stop sign in a short amount of time? Could that be held against him in the court, if a lawyer asked something like "How many people did you have to stop for what you considered to be running the stop sign?" According to Ms .... had you stopped 5 people before that night? What time frame did you stop these people?" Were they all stopped strictly for "running a stop sign", "speeding only" or both?

Is there a chance I can find out who cut the tree limbs and use them in trial?

I have two conflicting views about paying the ticket. My ticket does not require me to go to court, but I can if i want to testify or what ever. Person A is telling me I should fight it off because of insurance. Person B told me if its my 2nd violation in a certain amount of years the points would go on my record of course, but it should not affect my insurance. He said because his was not affected. I told him that person A told me I needed to try and fight it, because he couldn't afford a lawyer to fight it, so he goes to court(even though I don't know if he was required to) and gets points put on to his record, causing his rates to go up . Guy B explained the reason why that Guy's A ticket went up was depending on when his last traffic offense was, any other criminal violations, he has a sports cars, and he uses his car for work purposes as a delivery driver. So that is why, his might have gone up. Guy B told me just to pay the ticket, is saying that it is better to do that than to to worry about the court cost, lawyer cost, ticket cost, etc.

Should I try to get off my parents umbrella policy in case something does happen? Somebody told me that everybody could be affected. However I don't think that is fair to them if they were not driving the car. I read somewhere its best to change policies/providers before your insurance expires or rolls over to the next year. Is this true?

So in every body's opinion should I fight it off just in case or am I safe just paying it?

I have been reading on the internet about fighting tickets. These things include asking for a continuance because there is a chance If I ask for a different court date that the officer might not be there. There is also something called discovery where I can ask the officer for his notes to prepare my defense. Is this true, and do a lot of officers given away their evidence to the accused and/or has anybody reading this ever asked for discovery? Has any of this help you win a case?

How many of you try to fight your ticket every time you get one? How often do you win? Did you fight your first one to every one after that, or only when it seemed to matter? Is it good to fight it, if more than one car or person is on your insurance, just so it wont affect other people?
ok to me there is innocent in the fact that I actually did stop at the stop sign. However not guilty or guilty with justifiable causes would be that ok I might not not stopped at the stop sign, I stopped but not in the right place, I did not stop because I could not see it because of such and such?

Ok first of all this was at a night, but at 1:00 am when not a lot of cars on the road. There was a police vehicle the next day up the road. My friend said he saw the police car again driving one night and just tonight he saw the police pull somebody over in the same area I was pulled over, but he wasn't sure if it was for the same thing. It seems like that cop is just trying to get anybody he sees.

What Can I do about this traffic ticket?

I live in OK, got this speeding ticket about 3 weeks ago. When I was being pulled over into this neighborhood I was surprised because I couldn't think of what i might have been doing wrong. Officer told me I was Doing 62 in a 50, but he put me down at 59 and that it wouldn't go on my record. he told me i had been clocked at this bridge about a quarter mile up the highway from where I came, which is on a downhill slope. There were about 5 other cars that had been pulled over behind me as we sat there, along with one that was there before me. Was told by the officer that I had a court date to appear at, but that I didn't have to appear there, as long as I payed the ticket. Well, I had never been to a Court before, and did not believe that I had been going the speed he put me down for, either 62 or 59, so I decided to go. you see, im a constant watcher of my speed, and I will admit that I was speeding on this highway once I found out what the actual speed limit was. For some reason thought it was 55. In my defense, going down hill I never gas it, just let inertia do its thing, and I'm not a person who will ride their brakes because that is illegal. I was going with the speed of traffic around me, one of the main rules in the traffic laws book. And the officer never really specified who and/or how I was clocked. On the ticket there are four options for the officer to check: radar, pace, plane, other; he checked other and left no notes as to what this meant. anyway, went to this court and it turned out to be a room full of people having their names called out for their plea. when I was called up, I plead not guilty, thinking that that's what you do when you have been accused wrongly. Judge tells me the officer can charge me for the 62 instead and tells me to go to the next room where they assign me my next court date. Now I'm not sure what I've gotten myself into, I had no idea how this court stuff worked, just saw this as I was not guilty and now I'm being told I'll have to pay the ticket AND court costs AND the extra for the 62 AND 00 a year more in insurance and there is no chance of winning. So anyone with court experience have any suggestions? is it possible to undo my plea and plea no contest? or is everything already done and I have to learn the hard way? sorry for the Long question, but I am really stressed about this and looking for answers. =[

speeding tickets and public defenders.?

ok what is the difference between a defense lawyer and a public defender? Two people in law enforcement told me that in their answers when it came to fighting a speeding ticket.

Ok my friend thinks he needs a lawyer to get the ticket off his record because he is afraid it will be on there for 5 years and he has had other traffic viloations in the past. I think the last one one was 5 years ago. He is afraid of his insurance skyrocketing.

2 Speeding tickets, what’s going to happen with insurance?

I got a speeding ticket in November of 2006. I was doing 71 in a 55 and in my defense I never saw a sign for it and thought the speed limit was 65. Anyway on my way home for the fourth of july I got another speeding ticket so that would be in July of '08 I got one for doing 75 in a 70. The first time my insurance never went up and I was just wondering what would happen to it now. I live in Iowa and have gotten both of my tickets in IA and I am only 20 years old. I am still on my parents insurance. I have no other traffic violations on my record. Please help!

(telling me to not speed is not helpful, for your information both of these were speed traps and I was busted right after the mph sign was posted. Literally within two miles of it I really just want to know if and how much my insurance will go up)

i got a ticket from a state trooper in sutton county texas, can i go to driving defense school in my county.?

i recieve a ticket coming from san antonio tx, go home to el paso tx.. i was pulled over for speeding 91 in 80 speed limit zone in sutton county thats not all i also got a ticket for having my window tint in my car...
my understanding is state trooper gave me a paper to appear in front of sutton county jugde i dont live there, i cant go there again traveling cant ..
what can i do can i go too driving defense classes in my hometown of el paso. can i clear my ticket that way.. or do i have to pay it and have my insurance go up too....
how much is the fine for window tint in texas?
am lost please someone help me w/ info.......

Its strange that NO COP wants to believe if i say i have gotten 'incorrect speeding tickets'. Finally there is some scientific defense!

The sad thing is that a SCIENTIST really went and LIED about the accuracy of GPS devices in the case above! The sad truth is that GPS is not as prone to 'user error' as the typical police radar gun! Once the GPS is correctly installed, its accuracy is fairly 'constant'.

What are your thoughts on this?
What is interesting is that SOO many people believe wholeheartedly that an error is impossible. Here is someone who SAYS they werent speeding and has scientific evidence in his defence and you still have people who think a radar gun is 'almighty, infallible and accurate'.

Most people who believe this have NEVER studied how EITHER device works!
Which one is more likely:

1) did a young inexperienced driver magically change his speed sufficently and quickly enough to cheat a 15 to 30 second GPS snapshot that is DESIGNED to restrict speeding. OR

2) Did a police officer make an incorrect deduction in deciding which car to pull over?

If you think about it, both are possible but which one is probable? Unless the youth is a skilled precision driver, the device presents major DOUBTS about the case.

Was this particlar young man doing +60mph while skillfully maintaining 45 miles per hour by GPS.

This case presents MORE THAN reasonable doubt about the ticket.

Best defense for this ticket. Massachusetts state police.?

I recieved a ticket on 1/23/09 for running a red light and doing 70 in a 55. the alleged red light infraction was at thorndike st. and YMCA dr. in Lowell,Ma. the speeding was on rt3 over a mile away. i was apperantly tailed for a mile after they say i ran a red light which i honestly didnt do. and while i was doing 70 i was passed by multiple cars and wasnt payin attetion to my speedometer jus gaining speed to keep up with traffic. I dont want any bad mouthing of cops they were just doing there jobs. just real advice on the best way to go about fighting this ticket. the ticket says it was an estimate and they used Lider not rader i dont no the difference. Thats just wat the ticket says. ant real advice would b appreciated its a 0 ticket and i cant afford to pay it for something i dont think i did or was in the wrong for doing.

what are some commom defenses people use to fight speeding tickets in court?

I get speeding tickets all the time. as soon as i pay one off i get another one. i realize the best way to avoid them is to not speed but that is just not practical. Not because i feel i'm outside the law but because i realize everyone here speeds and law enforcement is simply collecting dues on this inevitability (because even cops break the laws--yes yes we've all seen it).
so i figure if this is going to keep happening (and get very expensive) i want to learn ways to get out of this!

i also love playing ball with the law so any intelligent suggestions on what i can do will definitely be considered!

i think maybe i could ask for community service or something..i just hate paying them all my money that i make because i make so little and i'm so young and want to at least save something!

how likely is it that this is a good enough defense?

mmk so someone i know got a ticket for speeding. teh person knew that their speedometer was a little off because the tires are a bigger size and the vehicle is very old. when the person told the officer that, he wrote the ticket, gave them a court date, and said that if they got the speedometer calibrated and brought proof that it was off to court, then the cop would dismiss the ticket.
so that DOES mean that if they get it calibrated, the ticket will be dismissed? i mean if thats what the cop told them, thats what should happen right?

I have a restricted license and i got a ticket going 38 in a 25mph school zone. The cop reduced it to 34 and it is .00. Im almost 16 and i have state farm. Will my rates go up. Should i just go to the office and pay it. I have no defense i know i was speeding. WIll my parents find out?

Does a cop have to have his lights on when he catches you for speeding?

I was wondering if it's true that a cop must have his/her lights on when they are sitting there trying to clock people on their radar. Will this type of defense work in court if he did not have them on, but he ticketed you for speeding? Several times I've seen cops sitting in places trying to catch people without their lights on, but can they ticket you if their lights were off?

I was in england, going to school. Got into a stupid fight at a gas station. I was purely acting in self defense.

Called the cops, but also was taken into custody. The cops said I should have walked away, as I had a chance.

Based on that I was taken into custody, taken to the station, booked, given a ticket/fine and released. However, that ticket will be on my record in England, not sure for how long.

The ticket was for "causing harrasment and alarm to public due to my words and behaviour".

No further action was needed other than paying the fine, which I did. No court hearing, no conviction, nothing else. That was the end of it.

This is the one and only trouble with the law in my entire life. One stand alone incident, of course have had speeding tickets. But no warrents or anything.

I want to apply for a federal law enforcement job, with ICE, CBP, FBI and so forth.

Would this ticket disqualify me from getting in? Or would this be a problem for me in any way?

I need the opinion of a criminal defense attorney?

I was charged with DUI with serious bodily injury. My passenger was injured. He is going to be alright, thank god. I have no record, just a couple speeding tickets. I have an attorney, but I am looking for other opinions on the best way to fight this or possibly get me a better outcome. I live in Florida. Thanks for the input!

Should I fight my speeding ticket?

So I was pulled over on I-287 yesterday by a nj state trooper. He said I was going 90 in a 65mph construction zone. The method he used was guaging. He said he was doing that for 2 miles but I think thats bull because I would have seen him. I also wasn't doing any more than 80. Should I fight this and if so does anybody have any defenses.

speeding ticket question (massachusetts)?

So, um, I got pulled over on the masspike (if youre not from mass - its a highway that is also called rt 90). The cop just handed me the ticket and told me I had the right to appeal it, but he never asked me to sign it or anything. Since I have appealed it, can I use that as part of my defense, or does it not really matter if he asked me to sign it?

Also, since my court date is tomorrow, what should I wear? Does it make a difference to the judge if I'm dressed up or not? And does the whole color scheme really send subliminal messages of innosence?

Speeding Ticket – Now What?

So I was in a straight stretch the other night and was going 68 in a 55. A state trooper pulled me over and gave me a citation saying that I was going 10 miles over the limit instead of 13. Will this go on my record and will my insurance go up being that it is my first citation/ticket? Should I just go and pay the citation or should I attend court? What would be the best thing to do? I'm guilty and going to traffic school will cost the same amount as paying the court costs and the fine. I don't need to go to traffic school as this is my first defense and am not going to lose my license due to having points taken off. Another question, I'm in Kentucky, how many points do you have on your license and how many are taken off in my situation? Also, what do I really need to do in this situation?

Answer all questions as I usually get responses that only answer one of my questions.

I have gotten a ticket for disobeying a red light in nyc. This is my first offense. What should I do?

I recently got a ticket for what the officer has said disobeying a steady red light. To me the light looked yellow then turned red when I was underneath it. I admit I was going a bit faster then the speed limit only because it was in the middle of the night and barely any cars out. The officer noticed but did not issue me a ticket for speeding. So this being my first offence in my almost 3 years of driving, what should I do? I reside in NYC.

My second question is that since I know if I plead guilty or I am found guilty the points will go on my license in which I will take a driver's defense course to remove the points. Only question is, even after taking the class and the points are removed, will my insurance still go up? My insurance company is Geico. Any help would be appreciated.

I got pulled over for the second time with having my license.
the first time i got pulled over i got ticketd for 50 in a 35 as a minor and now my second time as being 18 i got pulled over for 50 in a 35, following too closely and not wearing a seatbelt. I got pulled over in moraine. What am i looking at with these tickets? Could i take a driving defense class and usually how much are these. is there any way from preventing this from going to my insurance company? i have called the clerks office already and they said that my fine would be 250 dollars so does that mean i dont lose my license. should i appear in court or just pay it.

How do traffic defense attorneys work their craft?

My son got a speeding ticket (100mph) on his way to Las Vegas New Year's eve. We have prepaid legal. The attorney said, she knows the judge and just pay her 0. and the citation will be dropped, no record, and insurance company not notified. She didn't even want to hear his excuse (actually he lacked one).
