Aprroximatly A week and a half ago I was cited for 51mph in a 35 mph zone. It was 8pm at night on a clear night. My route of travel was I had exited a freeway in hawaii on my way to a military base. The only sign visible was a yellow caution sign at the beginning of the multi-lane exit stating 35mph on the right shoulder. After about a 1/4 of a mile of disecting ramps 3 inways come together and form a six lane roadway which people have to merge atleast three different times to make the right lane for about 1/2 to 3/4 of a mile before splitting again for 2 different bases. The police were sitting at this split with 2 cars and about 6 to 7 officers. 2 cops were taking radar while everyone else was writing tickets presumably based on the info they were being fed. The ticket says that there two signs when in fact there was only 1 which said the words RAMP"above "35 mph". Second the ticket states a distance of 1065 which a presume is feet. My wife was sitting in the back. FIGHT IT

Alright so the background on this is i was doing 88 in a 65 and my radar failed to go off, as i saw the officer begin to pull out, i went to the right lane began to slow down, and took my radar off. The officer and me had a nice chat and he lowered it to 85 in a 65 so i wouldn’t get as many points. Now today i am gonna call the court and talk to the attorney. I am going to plead no contest and ask for traffic school , if they reject this offer can i still plea not guilty?

P.S. I don’t want to hear guilt trips or speeding is bad i will remove your comment, i race cars for a living and am certified i know what i am doing.
Alright because some of you say save it for the track, its a 500hp car that can do around 156 so 85 is safe. Second thruways were built in ny for motorist to be able to do 100 safely that is why no bend is less than 1 mile long with out a bunch of signs. Third if you have ever been on the autobahn or have a license in germany you would know there is a set rules for driving unlike the rules here in the state were all you fat slow drivers that sit in the fast lane doing 65, when every few 100 yards there is a sign saying slow traffic stay to the right. Stop being a hypocrite saying don’t do it cause i know you have before to the question is about changing a plea answer the question and don’t leave your bs 2 cense because it is following on deaf ears.

I am 17 years old, and this is my first speeding ticket. It happened in Maine which is where I also live. I was driving at a speed of 92 on the interstate which is 27mph over the posted signs (65mph). Luckily I wasn’t going 3 mph faster or it would have been criminal speeding. I got a pretty hefty fine which is definitely an eye opener and I have learned my lesson.
I am just wondering if I will lose my license.. I’m pretty sure I will for 30 days but I’m not sure. Please tell me what you know about this for the State of Maine laws and if I will lose my license it will help if you could tell me how long for.

thanks
Why are some of you saying 95mph? I clearly wrote 92.
If you were in this situation and someone asked you why were you speeding? Most of the time you don’t have an excuse. Everyone just wants to get some wheres faster. I know it was wrong and I have a 3.00 fine to tell me that. Please just try and answer this question without telling me what’s right and wrong.
thanks.

The White Speeding Signs with the Speed numbers listed on the highways and roads, and interstates, are showing us the MAXIMUM Speed allowed by the law, not the Officers. They Officers uphold the laws, just like the Military does not tell their comanders they dont want to fight, they do it, they took the oath to uphold the constitution. We have the choice as Drivers as to weather we want to break the laws we learned and that are posted. If we go through a red light or stop sign, then we broke the law, if we speed any numbers over what is posted, then we broke the law, If we dont have our seat belts on, then we broke the laws, If we dont turn on our turn signals or cross over a solid white line to change lanes, then we are breaking the laws A solid White line is to be treated as a Solid Wall or barier and not using your signals will leave you possibly at fault in incodents as you are not letting anyone else know your intentions of changing lanes or turning off. So Quit complaining

There was one of those "your speed is….."signs on the highway, i went thru going 5 over and the thing instead of showing my speed gave me a flashing red line. it was really dark and i went by fast obviously lol so i dont know do u think it may have taken a pic of me.

Im in llinois, what are the charges like for going 5 over and also how long does it take them to mail u your ticket if you speed thru a speed photo radar.

I got a speeding ticket for doing 55 in a 35 zone. I am not from the area and there was no speed limit sign. As far as I could tell I was on an entrance ramp to a highway but the ticket says "access road". It was a 2 lane road with shoulders only merges onto the highway and nothing else on the road (it’s the tangle of highways and roads around Newark Airport in NJ).

Is that a valid ticket? Can I fight it? Without any signs and a road that looks like a regular highway ramp how is someone to know?
A question was asked as to what was the speed of the road I was coming off. I entered the entrance ramp from a stop light on a city street. The highway speed limit is 55 posted just past the merge.

To the person who said there is no prosecutor, you are wrong. I understand from others that in NJ there are prosecutors and you can ask to talk to them and agree to pay a fine instead of points. I do not believe there is traffic school in NJ

My real question though is how can this be fair? Even on maps and GPSs its shown as a "ramp" What classifies the road as an access road or a highway ramp? The road is one way, 2 lanes wide maybe a half mile long and only leads to the highway with no access to anything else.

Last week I was given a ticket for going 45mph in a school zone ( near a public high school) I understand the trafic laws but in my defense, even though it was 20 min before school, there were no students in sight (except for one J walker). In addition, the street that I got a ticket on was a main street.

The signs say " 25mph when children are present"

Do you think that if I made a video of the street during the same day and time of my ticket to show that there were no students around, and I was going at the flow of regular trafic, that I could have my ticket removed.

This is my first ticket…and to make matters worse, I was going to work at the schooll where I got a ticket. please give me some advise…. thanks

I was driving at night on the freeway and i decided to speed because there were no signs of any cars infront or behind me. I was going up a hill and i hit 110. going down the hill, i slowed down to 55 and then continued at 65. 10 seconds later, a car enters the freeway ramp and follows me. it was a cop and i got pulled over for speeding. how can he claim he clocked me at 103 when the only time he saw me was when i was doing a safe 65?

A road where I live was changed from 60 to 45 almost 3 months ago, but still at any given time there are up to 6 cars pulled over on the side of the road. For God’s sake they have bright orange flags sticking from the speed limits signs. Then they bitch about how the "goddamn pigs" have nothing better to do other than pull them over for going 70 in a clearly marked 45 zone. These people do know that the little black number on the side of the road isn’t a suggestion, right?

Hey, im 19 years old and thats my first offence, i was leaving college, and was driving out, and got pulled over by the cops, and shocked to know that i was driving 41 mph on a 25 school zone! the signs are impossible to see! when i call, it says that its appearance in court is mandatory, i would like to know how bad is my offence? and what should i do in court, again its my first time so i dont know what happens exactly in court.. anybody with that kinda experience plz tell me. Again i live in Georgia, dekalb county. thanks
Also, how much would be the fine, if there is one

today i was on my way home from the post office when i saw one of those signs that display your current speed. i was going about 10 mph over the speed limit. just before i slowed down a light underneath the sign flashed a few times. is this a speed camera/speed trap? should i expect a ticket?

Lately, photo radar tickets in my neighborhood are out of control. The thing that annoys me most about them is that they seem almost impossible to contest. If I went five miles over the limit in a specific area of a busy street, how would I know? Worse, they don’t even post signs telling you if photo radar is in use.

I think that it’s wrong, as well. I have serious doubts about the legitimacy of speed camera. Machines are broken all the time. Tell that to the driver/victim.

What’s the best way to beat photo radar, or the ticket, if you get one?

I have 3 points on my license already, and i was driving home on a road which is a 40mph zone about 200 yards away from it turning into a 60zone. about 2 minutes later i was pulled for speeding. When i was on the 40 zone i started speeding up and was going 59mph, and on the side of the road was an undercover police man with a speed camera in his car. Another police car pulled me taking the third parties word that i was speeding. there was no signs about speed traps and he was undercover, is there any way i can avoid these 3 more points? i am a delivery driver and i would lose my job. the only things i can think of to fight this is if the speed gun was calibrated correctly or plea for a speeding course. any suggestions?
i didnt no i was gong 59mph the police told me thats how fast i was going.

Tonight a friend of mine got pulled over for going down a one-way street. The street was clearly labeled with "DO NOT ENTER" signs. The cop gave him a reckless driving ticket but did not indicate anything about speeding. Also, he cut through a parking lot to avoid a light prior to going down the one-way street. In Michigan, the offense is worth six points. He has zero points on his record but a prior five-over speeding ticket.

Any advice on how to go about dealing with this? Any guesses as to the repercussions?

Thanks.

I was watching an episode of Top Gear (British Car Show) and they did a stint in Japan with the new Nissan GTR. They talked about the speed cameras. But they mentioned that they were marked so drivers had a warning.
I live in a pretty much crime free area, so the police are either busting up parties (not saying its a bad thing, but the truth) or setting speed traps.

Would it be illegal for me to post a sign, much like a campaign sign down the road from the officer warning drivers about the speed trap?

The police has recently addressed an internet mapping system that shows the most common locations for speed traps, they didn’t care about it because the point of speed traps is to make people slow down, not to write tickets. My signs would have the same effect. (that is my logic at work)

I was doing 51 in a a zone the signs say 45. The ticked I got in the mail said I was in a 40 zone. That’s crap. I can appeal it, anyone have experience with this, and if so how should I contest it and what should I say?

I was driving down a hill into a small town in Michigan a few weeks ago. There are signs which say 25 mph and hill braking required. There were 3 cars in front of me. I checked my speed and was braking at 25mph.

There was a police officer wayyyy down at the bottom of the hill in the opposite/oncoming lane before the main intersection.

I was pulled over on the second last day of the month and told I was going over 40 mph but the officer only gave me 5 over with no points.

My husband was driving the car in front of me, and he was braking at 28 mph. Had I been driving over 40 would I not have ended up with my bumper in his backseat?

I have scheduled an informal hearing. Do I have a snowball’s chance in hell? :P

0 is a lot of groceries.
Also the officer wrote the wrong address on my ticket. Is that significant?

I went to trial and lost. Now I’m appealing. Based on the 3 submitted briefs, will I win this thing? You can find the briefs posted here:

http://forum.freeadvice.com/showthread.php?t=386652

I am not ignorant of the law. In fact, I know the law requires signs to have an enforceable speed limit. In my brief, I did not contest that I was driving faster than the speed limit. I’m only saying that the limit cannot be enfoced due to the loophole in the law.
I am not contesting the fact that the speed limit is 65. Posted signs say so. Therefore, 55mph is not the limit. The only question here is do you need a posted sign at the spot of the alleged violation to enforce it THERE or can the police only ENFORCE it near posted signs? I’m arguing that the speed limit is valid, it’s just not enforceable at the exact spot he got me. Therefore, I shouldn’t have to have my insurance rates get tripled to 0/month.
Keep in mind that if I win my case, the police can still enforce and patrol traffic on the expressway in two ways:

1. They can write tickets for "too fast for conditions"

2. They can write tickets for "unreasonable speed"

3. They can write tickets for violating the posted limit, but only where there are signs.

Also keep in mind that a 65mph speed limit is LOW. It is not unsafe to drive at 86mph when the conditions permit, as in my case. Some states have 80mph limits. Some countries don’t even have limits!
Special note to "Trooper3" – yes they do use the word "effective." The 65mph was "effective" because signs were posted. The limit also happens to be enforceable in those areas. In my area, the limit was "effective" but not "enforceable" because a sign was not reasonably visible.

I was on the interstate heading back to Va. when I got a ticket in NC for going 72mph in a 55mph. I have actually never had a speeding ticket before. I completely missed the signs where the limit went from 65 to 55. I told him I didn't even see the signs and thought I was traveling within the limits. The cop asked for my license and I gave him my Va. license. The problem is he ran my name and pulled up an old address from the town I got the ticket in. This was 3 years ago and I lived there for like 3 months with a friend while I was pregnant and unemployed. The cop implied since I have an address there I must be from the area and told me since I was going to 15mph over the limit I would have to return to NC for a court date. On the ticket it says The State of NC versus my name and it lists my old address from that town and references my old driver's license number. WTF? Why isn't my current Va. address and drivers license noted. It makes it seem like I still live in NC. I don't understand why people who live out of state have to return.

Are there any options as to fighting this? It says on the ticket not showing up can result in warrant, license suspension. Is it referring to NC license that I no longer even have? This makes me so mad because there are people out there who deliberately speed but I never willfully speed and just feel like an idiot for not seeing the signs.
The cop said I can't pay the fine in the mail. I have to show up in court.
There's no amount on the ticket.

after a snow storm the officer said I was speeding in a area where many of the signs had been frozen over and it is a back country part with no lighting 10 over. in any case is it ever worth it to fight speeding tickets in court what are mine or anyones chances of winning.

I got a speeding ticket in Scottsdale, AZ by an unmanned camera that caught me going 11 miles over the speed limit. Conviently they only give tickets for people going 11 miles or higher over the speed limit. There were no signs posted about the radar or anything. I live on the East Coast, I was wondering how it would affect me if I didn't pay the ticket.
